Bond / Bond Redetermination Hearings

Any foreign national detained in the custody of DHS pending removal/deportation proceedings will either be given a bond or be set at no bond. In many cases the foreign national has the right to request what is called a bond redetermination hearing. A bond redetermination hearing or bond hearing is an informal proceeding whereby the foreign national requests that an immigration judge lower or eliminate a bond set by the DHS. These proceedings are distinct and separate from the removal/deportation hearing.

  2. Community or property ties to the United States;
  3. The reasons why the foreign national is in DHS custody;

  5. Whether the foreign national has any relief from removal and if so the likelihood of success on the merits of his or her claim.
